TERMS & CONDITIONS

1. Scope and Acceptance

These Terms and Conditions govern the use of the website jungleamazon.com and the services offered by Jungle Amazon, an adventure tour operator located at Av. El Sol 580, Cusco, Peru.

By making a booking or using our services, the client declares having read, understood, and fully accepted these terms. Jungle Amazon reserves the right to modify these terms at any time, notifying changes through our website.

2. Bookings and Payments

To confirm a booking, the client must complete the reservation form available on our website or contact us directly through the following channels:

Tours require a 30% deposit of the total value to confirm the booking. The remaining balance must be paid at least 15 calendar days before the tour start date.

Prices published on our website are expressed in US Dollars (USD) and may be subject to modifications without prior notice until the moment of booking confirmation.

3. Cancellation and Refund Policy

Cancellations must be communicated in writing to info@jungleamazon.com. The refund policy is as follows:

• Cancellation more than 30 days in advance: 100% refund of the deposit, minus USD 50 administrative fees.
• Cancellation between 15 and 30 days in advance: 50% refund of the deposit.
• Cancellation less than 15 days in advance: no deposit refund will be issued.
• No-show or cancellation on the tour day: no refund of the total amount paid will be issued.

In case of cancellation by Jungle Amazon due to force majeure conditions (extreme weather, closure of protected areas, etc.), the client will be offered the option to reschedule the tour or receive a full refund.

4. Itinerary Modifications

Jungle Amazon reserves the right to make modifications to itineraries when circumstances justify it (weather conditions, safety, lodge availability, etc.).

Any change will be communicated to the client as far in advance as possible. Under no circumstances will an itinerary modification reduce the quality or duration of the contracted service.

Tours include activities in nature; therefore, wildlife observation cannot be guaranteed at 100%, as it depends on natural factors beyond our control.

5. Client Responsibilities

The client agrees to:

• Provide truthful and complete information about their health status, allergies, medical conditions, and fitness level at the time of booking.
• Inform about dietary restrictions or special requirements at least 7 days in advance.
• Follow at all times the instructions of certified naturalist guides.
• Respect conservation rules and not disturb the fauna or flora of the protected area.
• Have valid travel insurance that covers adventure activities in remote areas.

Jungle Amazon is not responsible for losses, damages, or injuries resulting from the client's failure to comply with these obligations.

6. Jungle Amazon Responsibilities

Jungle Amazon is committed to:

• Provide certified naturalist guides with experience in each destination (Tambopata, Manu, Iquitos, Pucallpa).
• Guarantee accommodation in lodges with the quality and safety standards described in each tour.
• Provide basic safety equipment during excursions (life jackets for water activities, first aid kit, etc.).
• Inform promptly about any changes to the contracted service.

Jungle Amazon liability is limited to the value of the contracted service. We are not responsible for force majeure events, including but not limited to: natural disasters, closure of protected areas by government authorities, strikes, or extreme weather conditions.

7. Insurance and Health

It is strongly recommended that all travelers have international travel insurance that includes coverage for:

• Emergency medical evacuation from remote areas.
• Medical care at health centers in Cusco or Lima.
• Trip cancellation for health reasons.
• Adventure activities in tropical rainforest.

Jungle Amazon has first aid kits at all lodges and guides trained in CPR and basic first aid. However, we are not a medical services provider and do not replace travel insurance coverage.

8. Minors

Minors under 18 years old must be accompanied by a responsible adult throughout the entire tour. Some itineraries may have age restrictions due to activity intensity; this information is specified in the description of each tour.

The responsible adult must sign an additional liability declaration before the tour begins.

9. Intellectual Property

All content on the website jungleamazon.com, including text, images, logos, designs, and code, is the exclusive property of Jungle Amazon or its licensors.

Reproduction, distribution, or commercial use of any material from the website without express written authorization is prohibited.

10. Data Privacy

Personal information provided by clients during the booking process is treated in accordance with the Personal Data Protection Law (Law No. 29733) of the Republic of Peru.

Data is used exclusively for:

• Managing the booking and coordinating the contracted service.
• Communications related to the tour (confirmations, reminders, updates).
• Sending promotional information only if the client has granted express consent.

Data will not be shared with third parties, except for legal requirements or when necessary for service provision (e.g., associated lodges, local transport providers).

11. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Peru. Any dispute arising from the interpretation or execution of these terms will be submitted to the jurisdiction of the competent courts of the city of Cusco, Peru.

Before initiating any legal action, the parties commit to attempting to resolve the dispute through mediation or good faith negotiation.
